You can think of a Notario as a combination of the title company and the closing company, all rolled into one entity. A Notario is a real estate attorney that has been granted a federal license for life—much like a judge—to conduct real estate transactions in Mexico. Only a Notario can officiate the transfer of real estate from one entity to another, and they are legally responsible for doing the title search—just like a title company in the U.S.—and ensuring that you are receiving a fee-simple real estate title free and clear of any liens or encumbrances.
The Notario works in conjunction with a full legal staff to manage not only the title search, but potentially all issues related to the purchase of a property, like the SRE Permit, a Power of Attorney, or a will dictating what heirs will receive what division of your property.
