Where do I send that Earnest Money Deposit? Who holds the funds?

Mexican law dictates that a Mexican banking entity must control the transfer of funds so that the Mexican banking entity can be held accountable for the source and disposition of those funds. In San Miguel, all reputable real estate agencies use an Escrow Company, which acts exactly like an Escrow Company in the U.S.—they are an independent thirdparty agency that simply holds the funds in a neutral account, not releasing funds to the Seller until the Deed has been signed over to the new Buyer.

All parties remain protected this way. Money held in an Escrow Account does not earn interest for the depositor. I use TLA Escrow for all my clients, the only insured and bonded escrow company in San Miguel, your escrow funds are held in an FDIC insured bank in Dallas.
