Who pays the real estate commission and how much is it, usually?

As has been the case in the U.S. prior to the recent 2024 NAR court ruling, the Seller has always paid all sales commissions here. Because San Miguel de Allende lacks all the online services that make it easy for a Buyer to find a home by themselves online— unlike in the U.S., which was cause for the recent litigation—we feel that commission structure here in Mexico will remain as it has been.

As in all of Mexico, this figure is not a set figure, but in San Miguel commissions generally average six percent, and all real estate agencies submitting a Mexican Factura (invoice) are required to collect a 16% IVA tax on top of the commission amount, which is paid directly to the Mexican tax authority.
