Frequently Asked Questions For Buying a Home in San Miguel de Allende
You mentioned a will—tell me how that works for a home I might purchase in Mexico.

Here in Mexico, the Notario can build in a simple “Right of Survivorship” clause directly into the deed that allows the surviving spouse to automatically retain 100% ownership of the home once a spouse passes on…but only if all Buyers are physically present at the closing. They can also include a similar clause for surviving children. Remember that a U.S. will—even if it mentions your new Mexican home—is not valid in Mexico and therefore you always need some form of will in Mexico.

If the inheritance status of your home may be subject to change, it is best to create a separate Mexican will that dictates inheritance rights—the will can affordably be changed as often as required, the deed cannot be changed without expending substantial expense.
